1 Prices & Descriptions
All prices are as stated on the website, but we reserve the right at any time to revise the price of goods without notice. We have taken care in preparing the content of this website to ensure all goods have been fairly described. However, actual goods may slightly differ to those described. Weights, sizes and dimensions are approximate. Whilst we make every effort to ensure that all prices are correct, no responsibility will be accepted for errors and omissions. In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.
The colours or our cakes are matched closely but they may not always be identical to the ones shown on our website. The website pictures are a guide only and the final product may vary slightly. Where a customer has requested a specific colour, we will try our best to match it but please be aware that our buttercream, sugarpaste and sugarpaper do vary in colour and we cannot guarantee an exact match.
3 Shop Cakes
In these terms we refer to 'Shop Cakes'. These cupcakes are baked everyday for sale in the shop 7 days a week and form our signature collection.
All orders are subject to acceptance and availability. If the Goods you have ordered are not available on that day, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available or to cancel your order.
5 Order notice periods
For weddings, we need at least 3 weeks notice. For most other orders, please give us a much notice as possible to avoid disappointment!
6 Minimum orders
When not ordering cupcakes from our daily 'Shop Cakes' range, our minimum 'mini-cupcake' order is 20 per flavour. Our minimum 'large cupcake' order is 6 per flavour. This includes Gluten Free, Diary Free and Vegan cupcakes. Please ask us about minimum orders for other items.
7 Payment terms
We accept payment by cash, paypal or Visa Debit/Credit cards. For all orders we will require full payment before a order is processed.
8 Delivery charges
We offer delivery to postcodes within Manchester City Centre. There is a £5 charge for delivery.
We will deliver the goods to the address you specify. It is important that this address is accurate. Please be precise about where you would like the goods left if the intended recipient is out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).
We recommend that in cases where the person placing the order is not the recipient of the delivery they advise the recipient to expect a delivery. The Customer (the person placing the order) is responsible for the cost of re-delivery in cases where the recipient is not at the delivery address, on the day of delivery to sign and accept the goods.
For orders where a third party will accept and sign for the delivery on the recipients behalf e.g. a hospital, airport, college, university, workplace, secure housing with a doorman etc. the signature of any person authorised to accept a delivery on behalf of the customer shall be accepted as proof of delivery. We recommend that Customers inform any such third party to expect their delivery prior to placing an order to ensure that there is no delay in the recipient receiving their gift.
We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.
You will become the owner of the goods you have ordered when they have been delivered to you or your chosen recipient. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
10 Cake stand hire
Our perspex cake stands costs £15 per 24 hours hire. We will also require credit/debit card details as a guarantee against loss or damage to the stands. You agree that damaged or missing pieces will be charged to you at their replacement cost, including any postage/handling charged to us by the supplier. We will charge these costs to the credit/debit card. To help prevent damage, we agree that you may return the stands to us unwashed.
Hire of cake stands is at our discretion. The stands remain our property, and you agree to return the stands to us in complete and without damage by the agreed date.
Full payment is required when you order. Your payment represents an offer to purchase. Our acceptance of your order completes the contract between us.
12 Risk and ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
13 Cancellation rights
Under the Distance Selling Regulations you do not have the legal right to cancel orders of made-to-order items, which includes all our cakes and cupcakes. However, if we have not yet ordered ingredients for them, we may cancel your order at our discretion.
14 Cancellation by us
We reserve the right to cancel the contract between us if: We have insufficient stock to deliver the goods you have ordered; We do not deliver to your area; or One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will refund any payment you have made to us within 30 days of your order.
If you do not receive goods ordered by you within 7 days of the date for which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods.
If you notify a problem to us under this condition, our only obligation will be, at your option: To make good any shortage or non-delivery; To refund to you the amount paid by you for the goods in question in whatever way we choose.
Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent us by email to firstname.lastname@example.org All notices from us to you will be displayed on our website from time to time.
17 Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
20 Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
These terms and conditions will be governed by the laws of England and Wales and by using the Website you agree to submit to the exclusive of the courts of England and Wales.
22 Intellectual property
All of the content on the site including pictures, graphic design and text are subject to copyright and other intellectual property rights held by ‘Hey Little Cupcake!’ Ltd. The entire content of the site is copyrighted under applicable copyright laws. The use of our site heylittlecupcake.co.uk and it’s content is intended for the personal and non- commercial use by the users of our site.

You may download, view, copy and print documents and graphics incorporated in these documents (the “Documents”) from the Site subject to the following: (a) the Documents may be used solely for personal, informational, non-commercial purposes; and (b) the Documents may not be modified or altered in any way.
